Motor Vehicle Accident Claims
As a result of injuries sustained in a car crash, you may be entitled to make the following potential claims against car insurance companies:
- No-fault Claims
- Claims against the other driver (if you are not at fault for the accident)
5 Stars across the board!!!!
My wife and I were in a car accident in 2015, and right from the beginning our insurance company was giving us a run around, we didn't know if this is what is was all about so we contacted Ted at Stayshyn Law and everything from that day forward was as smooth as smooth could be. If it wasn't for Ted we would've never got the right help and medical attention required to live our lives to the fullest.
Accident Benefits or No-Fault Claims
These benefits are available, even if you are at fault for the accident and/or do not have your own car insurance coverage. You are entitled to no-fault benefits as long as they are reasonable and necessary and as a result of the motor vehicle accident.
Beware of Minor Injury Guideline (MIG)
As of September 1, 2010 if accident related injuries are considered to be a Minor Injury then the total amount payable for medical assessments and rehabilitation is restricted to $3,500.00. However, if you have pre-existing conditions or have sustained certain types of injuries which makes your need for treatment more complex, then your injuries may not be categorized under the MIG and will provide you access to $50,000.00 in medical and rehabilitation benefits for your treatment.

Claims Against the at Fault Driver
If you are involved in a motor vehicle crash and the accident is not your fault, you may have a claim for the following losses: Pain and Suffering, Housekeeping Costs, Future Care Costs, Out of Pocket expenses and Medical Expenses not covered by standard accident benefits coverage. Please note that claims for Pain and Suffering are limited to injuries that are deemed to create a permanent and serious impairment of an important bodily function and are subject as of 2021 to a deductible of $39,556.53 (which is indexed to increase each year). Navigating this threshold requires the assistance of your treating health professionals and a team of experienced legal professionals in motor vehicle law.
